Why is there a need to develop a new firearms by-law?

    Former Townships of Cornwall and Osnabruck had firearms by-laws. These former by-laws were repealed and incorporated into a Nuisance By-law in 2016. Some requirements related to firearms were in the former Nuisance By-law. The Township has received complaints about use of some firearms in urban settlement areas, and requests from residents to use longbows in backyards.  These were cause for concern in relation to the safety elements and proximity to others, children and pets in the urban settlement areas of the Township. The draft proposed by-law is intended to prohibit use of these firearms in these areas only (see map on this page), it does not prohibit the use of legal firearms in the rural areas

    How will this be different than the federal regulations on firearms?

    The difference is in the definition, the draft proposed by-law is much more restrictive at this time. The opportunity for the community to respond to what’s proposed and the information received may result in changes to what is proposed at this time.

    Does this by-law include St. Lawrence Parks Commission properties and the St. Lawrence River waterways?

    No. The proposed by-law does not apply to the St. Lawrence Parks Commission waterfront properties or the waterway.

    The Township is not able to enforce this by-law on properties managed by the Province. 

    How will this new by-law be enforced?

    The initial phases of introduction will include an education component, the By-law Unit and the OPP have capabilities to enforce the by-law once it is approved and in force. The By-law Unit will rely on the authorities granted under the Municipal Act and the Township By-law. The OPP will be relying on the Criminal Code and the Township By-law in relation to the Urban Settlement Areas and would support the By-law Officer if requested/necessary.

    When do you expect this new by-law to come into force?

    The by-law is anticipated to take effect in March, but ultimately will depend on feedback received, time needed for review and research the feedback information and Council wishes.

    The Township has also shared the draft document with the OPP and are awaiting comments from the Long Sault Detachment.

    What areas are affected by the proposed Firearms and Bows By-law?

    The by-law proposes restrictions to use of firearms and bows in the Urban Settlement Areas of the Township only. Rural areas are not subject to the proposed restrictions of this by-law.
